If you had been following Seattle condo news last week, you probably noticed that the owners at Queen Anne High School received a favorable ruling in King County Superior Court.  The court awarded the Queen Anne High School Association 9.4 million dollars.  The lawsuit alleged that major construction defects were present at the historic building. Those defects include unprotected drywall and wood framing, substandard windows and drains, insufficient weatherproofing, joints/flashing and water damage.  Some owners reported failed drywall, water stains, dry-rot in floors and framing, failed mortar and flaky bricks and terra cotta.

The important lesson in this story is how these issues can inhibit owners from buying, selling and re-financing.  It is a well known fact that lenders are “nervous” about underwriting loans on condos in general.  When you add lawsuits and pending assessments, almost everyone in the lending world will refuse to give money to even the most qualified of buyers. With that said there were a few sales during the period of litigation.

During the last 12 moths:

The future of building is a bit unstable. I anticipate that the developer will continue to pursue a settlement from their insurer.  As an owner in the building, I would stay put if you can.  As a buyer, I would watch the situation closely. Once the dust settles and the repairs have been made, then I think you can consider this building an option. For those optimistic about the buildings future, there are 2 units scheduled to be sold at foreclosure auction on Monday the 28th. Foreclosure buying is an opportunity to benefit from a deep discount.  So if your strategy is buy and “hold”, then a foreclosure purchase may be a good option. Especially given the limited inventory.

I thought I would share a quick update from this weekends foreclosure auction.  There were a number of units that I had been following leading up to Friday morning: A studio at Belltown Court, a 19th floor unit at Cosmopolitan and a penthouse unit at Avenue One in Belltown.

Belltown Court #728:

Unit #728 was on the mls just last year.  It is a 579sf top floor studio with a private view deck.  It last sold in August of 2007 for $292,000.  On Friday the minimum bid for the property was $101,489.  I was told that the final sale price was $110,000.  wow.  Considering that one-bedroom studios can rent for as much as 1,400 per month in Belltown, this could be a pretty sound investment for the new owner.

Cosmopolitan #1907:

Many of the one bedroom units at the Cosmopolitan selling at Foreclosure have been successful. Especially the north facing units.  This particular unit, like many other west facing condos in the building is heavily encumbered by the 1918 office tower next door.  With that being said it is a 800sf unit on the 19th floor.  One would think that an investor at the auction would have paid the $240,000 for it when it became available.  It sold in June of 2007 for $445,000.  Suprisingly, it never received a bid.  It reverted back to the bank and we will likely see it as a REO/Bank Owned listing soon.

Avenue One Penthouse #PH02:

For those of you unfamiliar with Avenue One, it was built in 2005 by Intracorp and is located at the corner of 1st and Clay in Belltown.  I’m always surprised to see penthouse units on the auction block.  This unit was purchased in 2005 for $980,500.  It never received a minimum bid and therefore wasn’t available for sale at auction.  It was postponed by the bank.  I will continue to monitor the situation.

Have you seen these townhomes in Eastlake?  As some of you may know, they came back on the market as banked owned over the last 30 days (Sterlings Saving Bank). Recently Kennedy Wilson Announced that 8 of them would be going to auction.  So they are now a part of a 46 property auction on August 7th in Seattle.  I spoke with a representative today and it sounds like they may only have to auction 2 out of the 8 properties.  Number 41 and 42.  See the brochure here: KW Auction. Just last week, some of the properties were put on the market and had multiple offers. If all those homes go under contract, there would be just 2 remaining (consistent with what I heard today). It is important to note that these remaining homes can sell before the auction.  So if you think you may be interested in buying one before August 7th, you can get in touch with the listing agents or the Kennedy Wilson rep.

For you those of you that took an interest in our post last week about the modern seattle townhome project going to auction, I thought I would share the results.  As expected, there were a number of bidders.  The opening bid started at $986,000 and was “bid up” to $1,080,000.  I learned that the buyers payed all cash and had plans on fixing/finishing the units and then brining them back to the market.  In my opinion, this was an excellent opportunity for this type of situation.  I’ll be keeping an eye out for when they hit the market.  For anyone that wants to tour the units, let me know.  I’m going to try to get a look at them this week.

Many of you are aware of the Fairview Auction today in Mukilteo.  I’m not as confident about this auction as I have been about others in the past.  I don’t believe the appetite for condos in Mukilteo is nearly as strong as they will need it to be in order to have real success with todays offering.  With that being said, it is an exciting day for buyers, the developer and the lender.

A few considerations:

  • A riskier purchase with the condo market still seeing declines
  • I’ve heard the project doesn’t have garbage shutes.  Walking garbage down to the dumpsters seems like a nuisance
  • This is truely a condo project in a residential market.  Much of Harbour Pointe is upscale residential homes; not multi-family.

As promised in my earlier post this morning the Olive 8 Auction results are in.  Click the picture below to view a detailed analysis on the numbers. In summary, 32 of the 34 units from the original “Auction Sheet” sold.   For reasons unknown, the developer elected to eliminate two of the 34 units.

Auction Statistics and Observations:

  • Total units sold 32
  • Average selling price $415,813.
  • Average selling cost per square foot $451
  • Highest cost per square foot sale $565
  • Lowest cost per square foot sale $381
  • The average discount given was 66% off the previous pricing
  • The auction results seem to favor buyers
  • There were an estimated 80-100 bidders and over 350 in attendance

As a side note, I wish to congratulate a client of mine that successfully purchased a unit today.  She had the support of me and her family, but deserves all the credit as she was diligent in her preparation and stuck to her game-plan.

Olive 8 Auction | Unpublished Reserve Prices

As the auction is less than two weeks away, I thought I would share some important information that you would only find by reading the fine print:

Unpublished reserve pricing or URP means that the seller has pre-established an “un-published” minimum selling price. All homes at the upcoming auction have URP.  The starting bid, although low and very attractive is not the reserve price.  This is a trick or sales tactic to get more people in the door.  Don’t worry.  This is not a deal breaker for me if I’m buying.  I don’t necessarily care what they “need” in terms of a minimum price.  I just want to be focused on what I am willing to pay.

In order to become the winning bidder of a unit, a bidder must have the highest bid and meet or exceed the unpublished reserve price. The highest bid is subject to acceptance by the seller. If a bidder has the high bid, but it’s less than the seller’s reserve, the high bid, resulting in purchase documents is subject to the seller’s acceptance.  It may also be countered or simply rejected during the auction, in the contract room and/or within five (5) days following the auction.

Olive 8 Homeowners Dues

Quite a few of you have asked about the home owners dues for Olive 8.  They are $.55 per foot.  For example, one of the units going to auction is unit #1902 (see below as I have it highlighted it in red).

The unit square footage is 1,586.  Therefore the monthly HOA dues would be ($872.30 per month (1586 x $.55).

The Olive 8 auction has been confirmed (read here).  As seen on the Olive 8 blog:

The Olive 8 Sales Team is proud to announce that we will have 34 homes auctioned in September. The auctioned homes will be on our lower floors 18 through 26.

The sales office will remain open onsite and continue to sell floors 27 through 39 our “Sky Suites.” Now is a great time to buy a view home in Seattle’s tallest and most luxurious tower. The sales office is open daily from noon to 5 p.m.

Details in terms of pricing have not come out yet, but we should expect them this week.  I’ve heard that R.C. Hendreen, the developer for Olive 8 is deciding between Accelerated Marketing Partners and Kennedy Wilson to hold the auction.  If you have not attended an auction before, I would encourage you to go.  It is a little chaotic but entertaining to say the least.

I will look to post later this week with more details on pricing and my opinion on the value of buying at an auction.

Ok, let me begin by telling you that I will not be able to share my source.  With that being said, I’ve been told that the Olive 8 Auction is on.  The auction will be conducted on September 19th.  I originally heard it would be just 1 bedrooms, now I’ve heard that it will be a combination of 1 and 2 bedroom units.  The marketing and advertising may begin as early as this weekend, but most likely next week.  As I hear more, you will as well.

I feel lucky to have such good contacts in the Seattle/Bellevue condo market.  Having invested as much time as I have, it feels good to be able to share information with the UCS readers first icon smile Update | Olive 8 Condo Auction !
