Your correct; HOA dues do go up.  The fear with litigation, is that legal fees (in the case that the association loses) would drain the reserves and start an immediate increase in dues or assessments to make up for it.  When she found a project that paid HOA dues through 2011 and the project had some sustainable sales success, she felt more comfortable taking that step.  She also felt that there was less risk of an immediate increase as well.
